OPTUS “RECHARGE AND ALWAYS WIN” (“PROMOTION”) NO.10

HOW TO ENTER

To be eligible to receive an entry into the Major Prize Draw and win an instant prize, during the promotional period (between 12 noon AEDST on 31/03/11 and 11:59am AEST on 01/08/11 or earlier if all unique codes are exhausted), current Optus Prepaid Mobile or Optus Prepaid Mobile Broadband customers must recharge their current Optus Mobile or Optus Prepaid Mobile Broadband service with a monthly recharge spend of $30 or more during the period of a calendar month. For the purposes of the promotion, recharges will be reset at the end of each calendar month. It is a condition of entry that customers use their own Optus Prepaid Mobile or Optus Prepaid Mobile Broadband account for the purpose of entry into the promotion. Non Optus branded rate plans including but not limited to Boost are excluded from the Promotion. Optus Prepaid Mobile Broadband customers who are on the Mobile Broadband Connect plan are excluded.

Instant Win Component

Once the recharge has been confirmed as successful, the customer will receive an SMS to their mobile or mobile broadband text message box containing a unique code. The unique code issued must be redeemed within 30 days of recharge. If customers recharge in the last 30 days of the promotion the unique code must be redeemed by 11:59am AEST on 01/08/11. Customers must visit www.optus.com.au/alwayswin, between 12 noon AEDST on 31/03/11 and 11:59am AEST on 01/08/11, input the requested details including the unique code and either their Optus Prepaid mobile service number or their Optus Prepaid Mobile Broadband service number. Customers will be notified instantly of the prize they have won. If the winner has won a Product Prize, their account will be credited accordingly. If the winner has won a Content Prize, they will be directed to a content download page to redeem their prize. Optus Prepaid Mobile Broadband customers cannot win Content Prizes. If the winner has won a Physical Prize, they will be directed to a Physical Prize claim page where they will be required to input the requested details and submit the claim form in order to claim their Physical Prize. Physical Prizes will be awarded within 28 days of winner notification.

Selected Optus Prepaid Mobile or Optus Prepaid Mobile Broadband customers will receive an SMS with instructions on how to enter this promotion via SMS. These selected customers will need to send a reply SMS to 2121 containing the word “WIN” within 30 days of recharge in order to enter. Standard SMS charges apply and will not exceed $0.55. The instant prize will be automatically awarded to those customers who win either a Product and/or Content Prize. Standard data charges will apply when downloading the Content Prize. If the customers handset is not compatible and unable to receive the Content Prize they have been awarded they will be sent an alternative Product Prize. Those customers who win a Physical Prize will receive a SMS detailing the prize they have won with a unique code and URL www.optus.com.au/alwayswin. Customer will need to go online and enter the URL www.optus.com.au/alwayswin and follow instructions online to redeem their prize. Customers who do not receive the SMS with instructions on how to enter this promotion via SMS and try to participate by sending a reply SMS to 2121 containing the word “WIN” will receive an SMS with an error message. Monthly Major Prize Draws

Customers who, during the promotional period (between 12 noon AEDST on 31/03/11 and 11:59am AEST on 01/08/11), recharge their Optus Prepaid Mobile or Optus Prepaid Mobile Broadband service with a monthly recharge spend of $30 or more during the period of a calendar month are eligible to receive one (1) entry into the relevant Monthly Major Prize Draw for each dollar spent on a successful recharge. For example, if the Entrant spends $30 on a recharge, they are eligible to receive thirty (30) entries into the relevant Monthly Major Prize Draw. Entrants must have successfully redeemed their instant win prize in order to receive their eligible entries into the relevant Monthly Major Prize Draw.

Entrants must retain a record of their unique code(s) for all entries submitted.

Current Optus Prepaid Mobile or Optus Prepaid Mobile Broadband customers who purchase a monthly recharge spend of $30 or more during the period of a calendar month, via a selected channel, during a randomly determined bonus recharge time, may receive by return SMS up to twenty (20) unique codes and/or up to twenty (20) times the normal number of entries into the Monthly Major Prize Draw to which they would normally be entitled. The Promoter reserves the right, in its absolute discretion, to offer multiple numbers of entries and unique codes to those Entrants who recharge during a randomly determined bonus recharge time, at any time during the promotion. For the avoidance of doubt, if a Current Optus Prepaid Mobile or Optus Prepaid Mobile Broadband customer purchases a $60 recharge via a selected channel they may, at the Promoter’s discretion, receive two (2) unique codes via return SMS and / or one hundred and twenty (120) entries into the Monthly Major Prize draw instead of the one (1) unique code and sixty (60) entries which they would normally be entitled to.

TERMS AND CONDITIONS

1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is limited to Australian residents who are existing Optus Prepaid Mobile, or Optus Prepaid Mobile Broadband customers (“Entrants”). Employees (and their immediate families) of the Promoter and its agencies associated with this promotion are ineligible to enter. Optus Prepaid Mobile Broadband customers include who are on the Mobile Broadband Connect plan are excluded.
3. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the Entrant must read and consent to all terms and conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to this Promotion.
4. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant’s identity, age and place of residence) and to disqualify any Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
5. Incomplete, ineligible or indecipherable entries will be deemed invalid.
6. Multiple entries into the Monthly Major Prize Draws permitted, subject to the following: (a) unless specified otherwise by the Promoter, only one (1) entry will be awarded into the Monthly Major Prize Draw per dollar spent in recharging the customer’s eligible Optus Prepaid Mobile or, Optus Prepaid Mobile Broadband service; (b) the same unique code cannot be used more than once; (c) unrecognised codes will be deemed invalid; and (d) when applicable each entry must be submitted separately and in accordance with entry requirements.
7. Promotion commences at 12 noon AEDST on 31/03/11 and closes at 11:59am AEST on 01/08/11 or once all unique codes have been exhausted, whichever occurs first. Entries and all claims for instant win prizes must be received by 11:59am AEDST on 01/08/11. Entries close for each Monthly Major Prize Draw at 11:59am AEDST on the dates specified in the table below. The Monthly Major Prize Draws will take place at Optus Administration Pty Ltd, 1 Lyonpark Road, Macquarie Park NSW 2113 at 3.00pm AEST on the dates specified in the table below.

8. The Promoter reserves the right to draw additional reserve entries, and record them in order, in case an invalid entry or ineligible Entrant is drawn. Monthly Major Prize Draw winners will be notified by mail and the Monthly Major Prize Draw prize winner’s name will be published in The Australian on 19/08/11. Instant winners will be notified in writing instantly and the winners of instant prizes valued at over $250 who reside in Victoria will have their names published in The Australian on 19/08/11. All winners (for prizes valued at over $50 will have their names published at www.optus.com.au/alwayswin shortly after winning their prize. The Promoter’s decision is final and no correspondence will be entered into.
9. Prize Determination Conditions. (Unless stipulated otherwise by the Promoter, these Prize Determination Conditions will not apply to prizes awarded via the unclaimed prize draw).
   • Optus Prepaid Mobile customers who recharge $30 – $40 in recharge value over the period of a calendar month will only be eligible to win those prizes stipulated in “Silver Prize Pool Tier – Optus Prepaid Mobile monthly recharge spend of $30 – $40″ unless specified otherwise by the Promoter.
   • Optus Prepaid Mobile Broadband customers who recharge $30 – $40 in recharge value over the period of a calendar month will only be eligible to win those prizes stipulated in “Silver Prize Pool Tier – Optus Prepaid Mobile Broadband monthly recharge spend of $30 – $40″ unless specified otherwise by the Promoter.
   • Optus Prepaid Mobile customers who recharge $50 or more in recharge value over the period of a calendar month will only be eligible to win those prizes stipulated in “Gold Prize Pool Tier – Optus Prepaid Mobile monthly recharge spend of $50 or more” unless specified otherwise by the Promoter
   • Optus Prepaid Mobile Broadband customers who recharge $50 or more in recharge value over the period of calendar month will only be eligible to win those prizes stipulated in “Gold Prize Pool Tier – Prepaid Mobile Broadband monthly recharge spend of $50 or more” unless specified otherwise by the Promoter.
   • Optus Prepaid Mobile customers and Optus Prepaid Mobile Broadband customers who initially purchase between $30 and $40 but then subsequently accumulate additional recharges that exceeds $50 during a single calendar month, during the Promotional Period, will be eligible to win those prizes stipulated in the “Gold Prize Pool tiers.
   • Optus Prepaid Mobile Broadband Entrants cannot win Content Prizes.
   • Optus Prepaid Mobile Entrants cannot win the same category of Content or Product Prize two (2) times in a row. For the avoidance of doubt, if an Entrant instantly wins a 10 Free Promo Text prize, they cannot win a 20 Free Promo Text prize with their following entry.
   • Optus Mobile Broadband Day Rate Plan Entrants can only win RevUp Bonus prizes or Physical Prizes from the relevant Silver or Gold Prize Pool Tiers.
